After the Privacy Shield dissolved, the Commission entered into talks with the US to adopt a new adequacy decision that would meet essential equivalency and the CJEU standard under GDPR Article 45. 10 The US adopted Executive Order 14,086 ("EO 14,086") to satisfy CJEU concerns about state surveillance of transferred data. 11Pursuant to EO 14,086, the US then adopted Regulation 28 C.F.R. Part 201 ("C.F.R. 201"), which established the Data Protection Review Court ("DPRC") to review determinations made by the Civil Liberties Protection Officer ("CLPO") regarding complaints alleging violations of US law in US signals intelligence activities. 12 The Commission determined the US provided "essentially equivalent" protection for data transfers, allowing certified organizations within the US to transfer data under the DPF. 13 The DPF faced immediate legal pressure.Philippe Latombe brought an action to annul the Commission's adequacy decision, which the General Court of the European Union ("General Court") rejected. 14 While the General Court confirmed the DPF's essential equivalence, Mr.Latombe appealed to the CJEU. 15Additionally, Maximilian Schrems, the antagonist in the past two adequacy decisions, has confirmed his desire to challenge the DPF. 16 Developments in the US may further threaten the DPF's continued validity when it is reassessed in 2027, or if challenged in a potential Schrems III. 17 The possible overturning of Humphrey's Executor, and the resulting loss of independence of the redress bodies established under the framework, may effectively 10
